Judge Deems Pendleton\u2019s Homelessness Policies \u201cReminiscent of the 1700s\u201d<\/strong><\/h1>

Case Dismissed on Procedural Grounds, Homeless Women Still Face Fines, Jail Time, and Exclusions<\/i><\/p>

PENDLETON, Ore.\u2013 A judge in Umatilla County allowed a motion to dismiss the Pendleton homelessness lawsuit because the City has implemented new sheltering policies since it was filed. In the decision, Judge Hill said that Pendleton\u2019s previous ordinances were \u201ca shadowed return to fragmentary, exclusionary practices more reminiscent of the 1700\u2019s.\u201d The judge also noted that \u201cit took Plaintiffs\u2019 action to effect change\u201d to the city\u2019s policies.<\/p>

The plaintiffs were five women ranging from 40 to 63 years old who have been Pendleton residents for years.\u00a0<\/p>

\u201cSara, Beth, Laura, Lee, and Wilynda will continue to speak out for fairness,\u201d said Allison Nasson, legal fellow at Oregon Law Center. \u201cUnder Oregon law, cities cannot pass blanket bans on sheltering, or treat housed and unhoused residents differently. This procedural decision does not address whether Pendleton\u2019s current policies meet Oregon\u2019s requirements.\u201d\u00a0<\/p>

Under current ordinances 4052 and 4053 as well as previous city ordinances, the women face fines, jail time, and year-long exclusions from their home city for trying to stay safe outside and protect themselves from the weather, including extreme heat, smoke, or freezing conditions. For instance, tents are banned everywhere in the city between 7 am and 8 pm every day.<\/p>

\u201cThe weather can make you sick if you don\u2019t have any kind of protection. It can kill you,\u201d said Sara Shaver, one of the plaintiffs. \u201cEven though tents are banned everywhere in the city under the new rules\u2013just like they were under the old rules\u2013I\u2019ll have to use one. It\u2019s disappointing that the court didn\u2019t do anything to help us. We\u2019re just trying to survive.\u201d<\/p>

The City had previously reached a tentative settlement agreement with the plaintiffs that would have created more fair policies, waived fines, and approved funding to address homelessness. The City Council voted against the settlement and chose to continue the lawsuit on June 29.\u00a0<\/p>

\u201cCities around the state have found that housing assistance, shelter and services are more effective and humane ways to address homelessness than punishment,\u201d said Allison Nasson, legal fellow. \u201cHomelessness is challenging for cities, and brutal for the people living it day-to-day. Lasting, effective solutions have to balance the needs of all involved and follow Oregon\u2019s laws.\u201d<\/p>

In 2024, 43% of people living in Umatilla County<\/u><\/a> could not afford their basic needs, according to the United Way. The City of Pendleton has reported that one in five renters pays 50% or more of their income toward housing, and affordable housing is scarce.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

Lawsuit says Pendleton discriminates against long-time residents, violates state laws\u00a0<\/em><\/p>

Five homeless women filed a lawsuit in state court challenging Pendleton\u2019s policies targeting homeless residents. Oregon Law Center represents the women, and Legal Aid Services of Oregon also represents most of the plaintiffs. Pendleton bans \u201cresting\u201d anywhere in the city from 6 a.m. until 10 p.m., under the threat of fines, citywide exclusions, and jail time.\u202f<\/span>\u00a0<\/span><\/p>

The women plan to request a preliminary injunction, arguing that the city\u2019s exclusion policies violate the Oregon constitution, Oregon\u2019s ban on cruel and unusual punishment, as well as a law requiring that camping restrictions are reasonable.<\/span>\u00a0<\/span><\/p>

\u201cIt doesn\u2019t matter if it\u2019s freezing and pouring rain, once it passes 6 a.m., there is nowhere in town you are allowed to shelter under a tent or tarp,\u201d said <\/span>plaintiff Laura Thornton,<\/span><\/b> 44, who went to school in Pendleton and has lived there most of her life. \u201cWe need to be allowed to exist.\u201d<\/span>\u00a0<\/span><\/p>

Thornton has been ticketed and fined for being on public property in Pendleton, charged with criminal trespass, and barred from public parks and the library. In her court filing, she explains how city officials and police officers have told her to \u201cfind a different place to go\u201d or go \u201cto the county line.\u201d<\/span>\u00a0<\/span><\/p>

\u201cThe city is effectively telling people you\u2019re not allowed to exist, period,\u201d said <\/span>Allison Nasson, legal fellow at Oregon Law Center<\/span><\/b>. \u201cPunishing people simply for being homeless hurts people who are already struggling and does nothing to solve the issue.\u201d<\/span>\u00a0<\/span><\/p>

Pendleton Police have issued over 300 citations to 172 people since May of 2023. In addition to the daytime ban on resting, overnight resting is severely limited and not allowed in public parks. When police officers determine someone is \u201cresting\u201d at a time or location that is not allowed, they issue an exclusion order banning the person from public ways, or from all city property, for 30 days. If someone violates an exclusion order, they may be charged with criminal trespass, which could mean up to 30 days in jail or a fine of $1,250. Their exclusion may also be extended for a year.<\/span><\/p>

The plaintiffs are five women ranging from 39 to 63 years old who have been Pendleton residents for years. <\/span>One in four people<\/span><\/a> who are homeless are over <\/span>55 years old<\/span><\/a>.\u202f<\/span><\/p>

Plaintiff Wilynda Wardinski<\/span><\/b>, 63, is a lifelong Oregonian. She was ticketed for criminal trespass after sitting on church steps with her dog. In her court filing, she says the police officer who ticketed her said \u201csomething to me like, \u2018we don\u2019t want your kind here.\u2019 I said what kind\u2013 elderly and homeless? He told me I should leave town, go back where I came from.\u201d\u202f<\/span><\/p>

\u201cForcing people to move constantly and leave the only place they know does not end homelessness,\u201d Nasson said. \u201cThese residents just want to exist in peace in the city they call home.\u201d\u202f<\/span>\u00a0<\/span><\/p>

Pendleton lacks affordable and market-rate housing. According to the City, one in five renters pays 50% or more of their income toward housing. There is also very little shelter for people who are unhoused. Pendleton\u2019s one year-round shelter, the Promise Inn, has 37 beds. The Promise Inn only allows people to stay for 90 days at a time, requiring 30 days between stays. Guests must leave every morning at 9 a.m. and cannot check in until 5 p.m. Emergency seasonal shelter Neighbor 2 Neighbor has 26 overnight beds and limited daytime hours during extreme weather.<\/span>\u00a0<\/span><\/p>

\u201cHomelessness is on the rise in every city in Oregon because we simply do not have enough housing or shelter,\u201d said <\/span>Kit Morgan, board member of Neighbor 2 Neighbor and attorney at Intermountain Public Defender, Inc<\/span><\/b>. \u201cAs a community, we have a choice: cruelty and punishment, or compassion and solutions. We must focus on what actually works to solve homelessness and that means increasing shelter, building affordable housing, and preventing homelessness in the first place.\u201d<\/span>\u00a0<\/span><\/p>

Statewide, <\/span>Oregon has less than half the shelter beds<\/span><\/a> needed. Rent assistance, and eviction protection have been severely underfunded for decades, and were recently <\/span>cut by the Legislature<\/span><\/a>. Recent <\/span>federal cuts to Medicaid<\/span><\/a> and the government shutdown are expected to increase the number of people forced to live outside in Oregon.<\/span>\u00a0<\/span><\/p>

Oregon law requires that any restrictions on camping are reasonable. The law was passed on a bipartisan basis with support and input from Oregon cities and counties. In the 2024 <\/span>Grants Pass v. Johnson <\/span><\/i>decision, <\/span>the Supreme Court<\/span><\/a> specifically pointed to Oregon <\/span>state law<\/span><\/a> as an example of how states can manage public spaces amid a housing crisis.\u202f<\/span> \u00a0<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
